Lead-Free Products Mandated
All new water supply plumbing work in contact with drinking water must use Watermark Certified Lead-Free Products. This is now law in Western Australia.
Strict Lead Content Limits
Products containing copper alloy — such as brass — installed or replaced after this date must meet the "Lead Free" definition: a weighted average lead content of no more than 0.25%.
Three-Year Transition Period
A transition period began on 1 May 2023, during which Lead-Free Products were progressively introduced to the market to allow industry and homeowners to adapt.
Legal & Financial Consequences for Non-Compliance
If a landlord fails to comply with the new Western Australia plumbing law, they face serious legal and financial repercussions. Ignorance of the law is not a defence — the consequences are binding and enforceable.
Mandatory Rectification Costs
Landlords will be required to pay for the removal and full replacement of any non-compliant plumbing products at their own expense — with no ability to recover costs from tenants.
Fines & Penalties
Failure to adhere to mandated plumbing standards can result in significant financial penalties. In Western Australia, breaches of plumbing regulations can lead to fines of up to $5,000.
Rectification Notices
A plumbing inspector has the authority to issue a formal rectification notice requiring non-compliant work to be fixed by a specified date. Compliance with this notice is legally binding.
Voided Insurance
Insurance claims relating to water damage or plumbing failure may be voided if investigators determine that non-compliant or illegal materials were knowingly used in the property.
Disciplinary Action
Landlords who attempt to circumvent compliance by using unlicensed tradespeople for plumbing repairs can be prosecuted for permitting unlicensed plumbing work — a serious offence under WA law.
Important Notice for Landlords: These consequences apply regardless of whether tenants raise a complaint. Proactive compliance before 1 May 2026 is the only way to avoid liability. All plumbing work must be carried out by a licensed plumber using Watermark Certified Lead-Free Products.
